Yes it's jaywalking but regardless, the pedestrian's have the right of way. The officer should of payed better attention to his surroundings. It sucks that it happend, but the man seemed to be okay, and Iam sure that the officer didn't feel too good about hitting the man.

This is why pedestrians can be charged with jaywalking and this is why jaywalking is a law. This is a law b/c it says pedestrians only have right of way when the WALK light is on. If it says DONT WALK, and they walk, then it's jaywalking

I'm an attorney in Charlottesville and the police officer who hit the man DID NOT charge him. City police had to investigate and city police charged him, NOT the officer who hit the man. He was charged b/c he must obey signal that says WALK/DO NOT WALK. Pedestrian ONLY has right of way when there is no signal present for pedestrians. My law firm represented the man who was hit, so I know all the details |
